Commission Terms of Service

Copyright and Usage Guidelines

Commissions are for personal use only. All copyrights and licenses remain with the artist (me). I am allowed to post any and all parts of the process on my social media unless requested otherwise. I am allowed to include the artwork in my portfolio, and/or use it as examples for future clients. The client is not allowed to commercially reproduce the artwork (make money from my artwork), alter the artwork without my permission, or remove or obscure my signature if shared digitally on social media.

Clients are not allowed to use my artwork to plug in, train, or do anything with AI.

I have every right to decline a commission if I feel that my skill level may not meet your request.

Please wait patiently for your commission to be finished. Because I am an oil painter, it can take many weeks for the paint to dry, as well as extra time to varnish and for that to dry. You are welcome to ask for updates if there hasn't been one in a while. Allow an estimated 6-8 weeks for completion. However, this is only an estimate and not a guarantee.

Please be kind. Any aggressive, rude, or inappropriate behavior towards me during the process will result in your commission being cancelled. You will not be refunded.

You may post and share my artwork on social media, but give credit to @loveelioart

Reference Photos

Please provide visual references. Grainy and blurry photos will not be accepted. The photo must show a clear image of the pet's face. 0.5 images or photos with filters will not be accepted. The photographs provided for reference images must have been taken by you, or permission for their use obtained from the person who took them. If the commission is a gift, you accept full responsibility for sourcing and using images of the recipient’s pet. By sending me reference photos you grant me permission to use them in my publicity and advertising media.

Payment

Payment is via Venmo or Shopify invoice only. An email and phone number must be provided to send your invoice. A 50% deposit (NON-REFUNDABLE) must be paid before I start working. The other 50% is due at completion. You will not receive your artwork until full payment is received. If you haven’t paid 30 days after notification of completion, and I have not heard otherwise, I will assume you want to cancel the commission. 

Cancellation

If, for any reason, you wish to cancel your commission before the final payment is made, you can at any time and will not need to pay outstanding amounts. I will, however, keep the deposit and any other amount already paid to help cover loss of business and my time spent on the project so far.

By commissioning me, this means you have properly read, understood, and AGREE to the Terms of Service listed above and are obligated to follow them.
